Landy Marr Kats LLP has launched a proposed class action against the owners and management of 260 Wellesley.
The proposed class action seeks damages for the electrical, heating, and water outage in the building which began January 22, 2019.
The tenants, residents, and visitors to 260 Wellesley were forced to either live in the building without electricity, heat or water in the dead of winter, or vacate the property on little to no notice.
If you were affected by this incident as a tenant, resident, or visitor to 260 Wellesley, you may wish to keep a log of all expenses that you have incurred as result of the incident and any lost income as a result of the incident. Some examples of expenses may include but are not limited to additional mileage on your car necessitated by moving and/or a longer commute, gas expenses, additional time spent commuting, living expenses, lost property expenses, insurance deductibles, and any other out of pocket expenses.
It is important that you maintain any evidence that you have (such as photos and videos) with respect to the condition and contents of your unit prior to and after the incident, if anything was lost or damaged.

On March 6, 2020, the Ontario Superior Court of Justice certified this proceeding to move forward as a class action on behalf of people who were tenants, residents or visitors at 260 Wellesley during the power outage which occurred between January 22, 2019 and January 27, 2019.
