In this action, the NIOC was being sued for damages arising out of three contracts for oil drilling in Iran. Keith Landy and Stephen Turk, representing the NIOC, appealed a finding by the motions judge that the case should be tried in Ontario. Successfully arguing that a forum selection clause in one contract should be upheld, the Ontario actions against the NIOC relating to two of the three contracts were stayed, with the NIOC recovering 75% of their costs.
