Landy Marr Kats LLP has commenced a mass tort legal action in the Ontario Superior Court of Justice against a condo developer and related entities. The following parties are the named Defendants:
- 220 Dundurn St. Inc.;
- DIV Construction Services Inc.; and
- Denis Ivan Vranich
The action is brought on behalf of approximately thirty purchasers whose agreements of purchase and sale for units in 220 Dundurn Street South, Hamilton, Ontario (“220 Dundurn”) were terminated.
Each purchaser agreed in 2018 or 2019 to buy a unit at 220 Dundurn as a place to live or as an investment opportunity with the reasonable expectation that the developer would act in good faith to complete the deal.
The action seeks compensation for damages suffered when the developer instead transferred ownership of all 124 units in the building to another corporation and improperly relied on a condition in the agreements to cancel the deals with the original purchasers.
The action alleges breach of contract, breach of duties of good faith and honest contractual performance, negligent misrepresentation, conspiracy, breach of trust, knowing receipt of trust property, intentional interference with contractual relations and/or unjust enrichment.
